Eligibility

Eligibility information means: any communication of bearing on a consumer’s credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living that is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing the consumer’s eligibility for credit or insurance to be used primarily for personal, family or household purposes or employment purposes.

Eligibility information means, in each case, in relation to a Substitution Proposal, whether the Replacement Notional CTS would comply with the Eligibility Criteria, the Substitution would comply with the Conditions of Substitution and the Portfolio would comply with the Portfolio Guidelines following the Substitution (or where the Portfolio does not comply with the Portfolio Guidelines prior to such Substitution, the Substitution would not increase the extent of such non- compliance), assuming that the proposed Substitution is effected.
